These Terms of Service (the 'Terms') govern access to and use of the Spotwee platform, published by OBVEON GROUP. They define the rights and obligations of Spotwee and of users (Hosts and Renters). Use of the Platform and/or creation of an Account implies acceptance of these Terms.
Spotwee is a platform connecting, on one hand, owners or managers of venues (Hosts) wishing to offer their spaces for short-term rental, and on the other hand, users (Renters) seeking to rent these venues for various uses (private, professional or creative events). Spotwee acts exclusively as a technical intermediary and is not a party to the rental agreements concluded between Hosts and Renters.
For the purposes of these Terms, the following terms shall have the meanings set out below:
Registration on the Platform is open to any natural person of legal age and legal capacity, or to any legally constituted legal entity. Minors are not authorized to create an Account.
Registration requires the provision of accurate and up-to-date information: email address, password, and, depending on the chosen profile, first and last name. The User undertakes to keep this information up to date.
The User is responsible for the confidentiality of their credentials. Any connection or action taken from their Account is deemed to have been carried out by them. In case of suspected fraudulent use, the User must immediately contact contact@spotwee.com.
Only one Account per person is authorized. Creation of multiple or fraudulent Accounts may result in the closure of the relevant Account(s).
Spotwee offers the following features:
Search and consultation of Venues, adding to favorites, sending Booking requests to Hosts, exchanging messages with Hosts via the Platform.
Publishing and managing Venues, receiving and processing Booking requests, exchanging messages with Renters via the Platform.
Spotwee acts exclusively as a technical intermediary. Spotwee is not a party to rental agreements concluded between Hosts and Renters. Spotwee does not guarantee the actual availability of Venues, the conformity of advertised services, or the solvency or reliability of Hosts or Renters. At this stage of the service, Spotwee does not process any payment, and any financial transactions are concluded directly between the parties, off-platform. An integrated payment service may be activated later via Stripe.
The Host undertakes to:
A Host acting in a professional capacity remains solely responsible for their legal, tax, social, insurance and consumer information obligations. Spotwee reserves the right to request, at any time, the production of supporting documents (legal status, insurance, administrative authorization) necessary to validate the Host's professional status.
The Renter undertakes to:
At this stage of the service, access to the Platform is free for Renters and Hosts. No commission is charged by Spotwee on any transactions concluded between Users off-platform. Spotwee reserves the right to introduce in the future paid features (premium subscriptions, promotional options) or a commission system on transactions, subject to prior notification to Users. Any pricing change will not have retroactive effect on ongoing commitments.
At this stage of the service, no payment is processed by Spotwee. Any financial transactions between Hosts and Renters are organized and carried out directly between the parties, outside the Platform. Upon launch of the integrated payment service, it will be delegated to Stripe (PCI-DSS Level 1 certified). Specific terms of use for the payment service will be communicated to Users prior to its activation.
The Platform, its design, brand, editorial and technical content (texts, graphics, logos, icons, source code, organization, layouts) are the exclusive property of OBVEON GROUP, except for content provided by Users and third parties. Any unauthorized reproduction, representation, modification or exploitation is prohibited and constitutes infringement under Articles L335-2 et seq. of the French Intellectual Property Code.
By publishing content on Spotwee, the User grants Spotwee a free, non-exclusive, worldwide license, limited to the needs of hosting, display, technical reproduction, translation, promotion and distribution of the content on the Platform and its communication media, for the duration of publication of the content on Spotwee. The User warrants that they hold the necessary rights to the content transmitted to Spotwee, including texts, photographs, logos and information relating to Venues.
The processing of Users' personal data is governed by the Privacy Policy, accessible from the Platform. This policy is an integral part of these Terms.
Spotwee, acting as a technical intermediary and within the limits permitted by law, cannot be held liable for:
Spotwee undertakes, as an obligation of means, to deploy reasonable resources to ensure the proper operation and availability of the Platform, without guarantee of absence of error, bug or interruption.
The following are strictly prohibited on the Platform:
Spotwee reserves the right to moderate, suspend, remove any content or to close any Account in case of breach of these Terms, without prejudice to any legal action. Sanctions are graduated according to the severity of the breach: warning, content removal, temporary Account suspension, definitive closure.
Spotwee reserves the right to modify these Terms at any time. Users will be informed of substantial modifications by email and/or via the Platform with reasonable notice. Any use of the Platform after the entry into force of the modifications constitutes acceptance of the updated Terms.
The User may delete their Account at any time via their Account settings. Deletion is effective within thirty days in accordance with the Privacy Policy.
Spotwee may terminate a User's Account in case of serious breach of these Terms, after formal notice remained without effect for a reasonable period, except in cases of urgency or particularly serious breach justifying immediate termination.
In accordance with Articles L611-1 et seq. of the French Consumer Code, a consumer User may refer any dispute relating to a service provided by Spotwee to a consumer mediator free of charge, after a prior written complaint sent to Spotwee has gone unanswered or received no satisfactory response.

A consumer User may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
These Terms are governed by French law. Where the User acts as a consumer and resides in another Member State of the European Union, this choice does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence. The consumer may bring proceedings, at their option, before the courts of their place of residence or those of Spotwee's registered office; Spotwee may bring proceedings against the consumer only before the courts of the consumer's place of residence. For Users acting in a professional capacity, the courts having jurisdiction over Spotwee's registered office shall have exclusive jurisdiction.
The Platform provides an internal messaging system allowing requesters and owners to communicate following an inquiry relating to a venue, in order to prepare a possible booking, organize the practical arrangements for the event, and ensure follow-up of the exchanges.
Access to the messaging system is restricted to the two participants in the exchange as well as to authorised members of the Platform acting for support, security, abuse prevention, report handling or dispute management purposes, within the limits of their responsibilities.
You must not use the messaging system for purposes contrary to the law, these terms, or the legitimate interests of the Platform and other users. In particular, the following are prohibited, without this list being exhaustive:
Before acceptance of the request, the Platform may automatically mask certain direct contact details (email addresses, telephone numbers) in messages, in order to secure exchanges, limit fraudulent uses and prevent premature circumvention of the Platform. After acceptance, this masking may be lifted according to the applicable rules. This feature forms part of the normal operating conditions of the service.
The messaging system includes a mechanism allowing content suspected of being unlawful or contrary to these terms to be reported. Reports may result in human review, access restriction or removal of the content, retention of elements for evidentiary purposes, and any reasonably necessary measure to prevent recurrence. The Platform may request any useful information and cooperate with the competent authorities where required by law.
In the event of a breach of these terms, a manifestly well-founded report, an attempt to circumvent the Platform, a security issue or a risk to other users, the Platform may suspend or restrict access to the messaging system, remove certain content, or temporarily or permanently suspend the account concerned, subject to the applicable information obligations. Where the user is a professional, any restriction shall be implemented in compliance with the applicable information and reasoning obligations.
Messages are retained in the active database for 3 years from the last interaction, then deleted, unless there is a legal obligation or a need to retain them for the establishment, exercise or defence of legal claims. In the event of a report or dispute, the strictly necessary elements may be retained for a limited period in a restricted-access area.
The messaging system is not intended to be used independently by minors to transmit sensitive information or arrange a service without the intervention of a legal representative where required. Users undertake to limit exchanges concerning minors to what is strictly necessary for the organisation of the event.
When publishing a listing, the Host declares whether they are acting as a professional (an activity carried out on a habitual basis for profit) or as a private individual (outside any professional capacity); this declaration is mandatory in order to publish. This status is displayed on every listing so that the Renter can clearly identify whether they are contracting with a professional or a non-professional, in accordance with Article L111-7, II, 3° of the French Consumer Code. A Host acting in a professional capacity remains solely responsible for the resulting legal, tax, social-security, insurance and consumer-information obligations. Spotwee may request from any Host the necessary supporting documents (company registration extract, VAT number, etc.) and, in the event of serious doubt or fraud, reclassify the displayed status, suspend or close the account.

Only a Renter whose Booking request has been accepted by the Host and whose event has taken place may submit a review, limited to one review per booking: every published review is therefore based on a verified experience. Users undertake to submit only genuine, first-hand reviews. Spotwee does not alter the content of reviews and pays no consideration in exchange for submitting one. A review may be refused or removed if it is manifestly unlawful, abusive, unrelated to the service, if it discloses third-party personal data, or if it results from a fraudulent submission; its author is informed and may contest the decision. Full publication and verification arrangements are set out in the Platform information section, in accordance with Article L111-7-2 of the French Consumer Code.
